At Nosal & Jeter, LLP we help both residential and commercial property owners appeal the most recent 2019 property tax revaluation assessment in Mecklenburg County, North Carolina.
Every real property owner who received a written Notice of 2019 Real Estate Assessed Value has the right to appeal the assessed value of their property. This notice informs the property owner what the Mecklenburg County Assessor’s office has determined to be the fair market value of their property as of the valuation date, which is January 1, 2019. You can request an optional informal review within 30 days of receiving the notice (which may be beneficial to correct clerical data errors, such as incorrect square footage); however, a formal appeal must be filed on or before the May 20, 2019 deadline to have your appeal heard before the Board of Equalization and Review.
There are numerous pitfalls that property owners face in appealing their own tax value. The burden of proof is on the tax payer to present evidence that the county’s assessed value is substantially higher than the market value or is inequitable with similar appraised properties. You may “know” your property is overvalued but you must prove your case within the standards, rules, and statutes of North Carolina. As such, a property owner must make a legal argument and present compelling evidence that the assessed value of their property is incorrect as of the valuation date.
However, property owners are permitted to hire an attorney to appeal the property value on their behalf and represent them at the hearing. Our attorneys are here to provide the citizens of Mecklenburg County and the Charlotte metro area with the experienced, knowledgeable, and affordable representation in appealing their property tax value.
During the 2011 revaluation, Attorney Thomas C. Jeter III began this niche practice representing a single developer with multiple properties. After observing many property owners ineffectively argue their own appeals or become frustrated that the evidence they presented could not be considered, we began representing other property owners with their appeals as well. We successfully handled tax appeals for hundreds of properties during the 2011 revaluation period. We have a deep understanding of how the property tax revaluation process works and want to put our past experience to work for you in appealing your 2019 Mecklenburg County revaluation.
Our property tax appeal services include the following:
The most common, and often most costly, mistakes include presenting your opinion of the value based on non-qualified sales or using recent comparable sales and appraisal reports past the revaluation date. Short sales, foreclosures, and other distressed sales cannot be considered by the Tax assessor’s office or the BER when determining the fair market value of your property. Additionally, appraisals and comparable sales after January 1, 2019 cannot be considered.
